Terms of Use

These Terms govern the use of the Orby platform. By creating an account, accepting an invitation or using any part of the service, you fully agree to this document.

1. Definitions

  • Platform: set of Orby modules — chat, feed, projects & tasks, CRM (leads, deals, pipelines, catalog, interactions), documents, calendar, recognition, birthdays, statistics, administration and the mobile app.
  • Organization: contracting entity (company) with its own isolated workspace, departments, users and data.
  • User: individual invited into an Organization (admin, manager, employee, guest, etc.).
  • Content: messages, files, tasks, CRM records, events, posts and any data created by the User.

2. Account and eligibility

To use Orby you must be at least 18 years old and have legal capacity to enter into this contract on your own behalf or on behalf of the Organization you represent. You are responsible for the accuracy of the data you provide upon registration, for protecting your credentials and for all activities carried out under your account. We strongly recommend enabling the two-factor authentication (2FA) available on the platform.

3. Organization, roles and invitations

Orby is multi-organization: each company has its own isolated workspace. The Organization administrator manages users, departments, permissions, billing and settings. Invitations expire according to the configured rules. The administrator is the holder of the Organization's Content vis-à-vis Orby.

4. Acceptable use

You agree not to use the Platform to:

  • Engage in illegal or fraudulent activity, or activity that violates the rights of third parties.
  • Send spam, malware, phishing or offensive, discriminatory or harassing content.
  • Attempt to bypass technical limits, reverse engineer, scrape massively or perform load attacks.
  • Share credentials or use another user's account without authorization.
  • Upload copyrighted content without proper licensing.

We reserve the right to suspend accounts or remove Content that violates these rules, without prejudice to any legal liability that may apply.

5. Plans, prices and payment

We offer free and paid plans. Prices are presented in Kwanzas (Kz) and may include applicable taxes. Paid plans are billed in advance, on a monthly or annual cycle, as chosen. In case of payment failure, the Organization may enter restricted mode until regularization. You can cancel at any time — you keep access until the end of the period already paid for, with no proportional refund unless required by applicable law.

6. Intellectual property

You fully retain ownership of the Content you upload. You grant Orby a limited, non-exclusive and worldwide license, exclusively to store, process, display and transmit such Content as necessary to provide the service to you (including backups, search indexing, preview generation and internal statistics). The Orby brand, logo, software, interface design and documentation are owned by Orby.

7. Availability and support

We work to keep the Platform available 24/7, but we do not guarantee total absence of interruptions — scheduled maintenance, infrastructure failures or outages from external providers may occur. We will communicate planned maintenance with reasonable notice whenever possible. Support is provided by email in Portuguese and English, in Luanda business hours, according to the contracted plan.

8. Limitation of liability

The service is provided “as is”. To the maximum extent permitted by law, Orby is not liable for indirect damages, lost profits, data loss resulting from Customer misconfiguration, or interruptions caused by third parties (carriers, cloud providers). Our total liability is limited to the amount paid by the Organization in the 12 months preceding the triggering event.

9. Suspension and termination

We may suspend or terminate accounts in case of serious breach of these Terms, prolonged non-payment or legal requirement. After termination, the Organization has up to 30 days to export its data; after that period, data may be irreversibly deleted, except for legal retention obligations.

10. Privacy and personal data

The processing of personal data is governed by our Privacy Policy, which is an integral part of these Terms.

11. Changes to the Terms

We may update these Terms to reflect new modules, legal requirements or technical improvements. Material changes will be communicated by email and/or notice on the Platform with reasonable advance. Continued use after the changes take effect constitutes tacit acceptance.

12. Governing law and forum

These Terms are governed by the laws of the Republic of Angola. Any dispute will be submitted to the courts of Luanda, except where mandatory law assigns exclusive jurisdiction to another court.

This document is informational and may be reviewed by our legal department. In case of conflict with a specific contract signed with your Organization, the contract prevails.
